New Delhi: The Supreme Court will on Thursday deliver its verdict on the presidential reference, which asked whether the Constitutional Court can set time limits for governors and the President to approve bills passed by state legislatures. The Constitution bench of Chief Justice B.R.Gavai, Justice Surya Kant, Justice Vikram Nath, Justice P.S.Narasimha and Justice A.S.Chandurkar had reserved the verdict on September 11 after hearing arguments for 10 days.
During the hearing on September 11, the apex court had questioned the Center as to how the court, which is the guardian of the Constitution, can remain powerless if any one organ of democracy fails to discharge its duties.
Emperor Draupadi Murmu had asked 14 questions
President Draupadi Murmu in May, in exercise of powers under Article 143(1) of the Constitution, had sought to know from the top court whether time limits can be prescribed by judicial orders for the exercise of discretion by the President while considering bills passed by state legislatures.
The ‘Presidential Reference’ decision came after the court’s April 8 verdict on the Governor’s powers to assent to bills passed by the Tamil Nadu government. In a five-page reference, Murmu has asked 14 questions to the Supreme Court and sought its opinion on the powers of the Governor and the President under Articles 200 and 201 in dealing with bills passed by the state legislature.

A bench of Justices JB Pardiwala and R Mahadevan, in a judgment on April 8, said the Tamil Nadu Governor’s decision to withhold assent on 10 bills was “illegal” and “arbitrary” and set a three-month deadline for the President to assent to the bills.
A two-judge bench had observed that a considerable amount of time has passed since these ten Bills were originally passed and presented for the Governor’s assent and two of the ten Bills date back to 2020.
