The Supreme Court has issued notices to both the Commission and the Central Government regarding the amendment giving legal protection to the Election Commission of India (ECI). The court has issued this notice on a petition challenging the amendment of 2023, in which the Chief Election Commissioner and Election Commissioners have got legal protection while holding their official posts. The petition has been filed by non-governmental organization (NGO) Lok Prahari.

What is the law?
This law, which provides legal protection to Election Commission officials, was brought by the Central Government led by Prime Minister Narendra Modi in 2023, which is passed by both the Parliaments. Under the Appointments, Conditions of Service and Tenure Act, 2023, no court can file an FIR or case against the Chief Election Commissioner and Election Commissioners for acts done in official duty (such as election decisions, deposition proceedings). This protection applies to both current and former commissioners.
