Engineer’s death case in Noida: Allahabad High Court releases accused builder

Allahabad High Court has given relief to builder Abhay Kumar, who was made accused in the case of death of software engineer Yuvraj Mehta (27) due to falling in the basement last month in Noida, Uttar Pradesh, adjacent to Delhi. The court observed in the case that the arrest of Kumar, director of real estate firm Wisetown Planners Limited, was done without following mandatory procedures. The bench of Justices Siddharth and Jaikrishna Upadhyay has asked for the immediate release of Kumar.

What did the court say?

The court was hearing a petition filed by builder Kumar challenging the arrest. During this, the court found that the police did not follow the procedure under clause 13 of the arrest memorandum. Under this, it is necessary to inform the accused about the reasons for the arrest and to give a copy of the memorandum before detention. The High Court has canceled the judicial custody orders issued on January 20-21 by the Chief Judicial Magistrate of Gautam Buddha Nagar.

Yuvraj was a software engineer in Gurugram. He was returning home on the night of Friday, January 16, when due to dense fog, his car fell into the basement of the under-construction mall in Sector-150, Knowledge Park police station area. The basement was filled with water and there was no barricading and information around it. Yuvraj died by drowning in this. Builder Kumar was arrested in the case.
