Supreme Court is hearing about the privacy policy of WhatsApp

What is the news?

The Supreme Court has adjourned the hearing on the petitions of Meta and WhatsApp on Monday (February 9). In these, the order of the Competition Commission of India (CCI) was challenged, in which a fine of Rs 213.14 crore was imposed regarding the privacy policy. Chief Justice (CJI) Surya Kant’s bench was told that senior advocate Kapil Sibal was unwell, hence the hearing should be adjourned. Now it will hear the petitions for passing interim orders on February 23.

Supreme Court had made strict remarks

On February 3, the bench made strong observations against Meta and its owned social media platform WhatsApp, saying that they cannot play with people’s right to privacy in the name of data sharing. It was also alleged that they are creating a monopoly in the market and stealing personal information of customers. The bench said, “We will not allow the rights of any citizen of this country to be harmed.”

NCLAT also upheld CCI’s order

On November 4 last year, the National Company Law Appellate Tribunal (NCLAT) quashed a section of that CCI order. In this, WhatsApp was banned from sharing data with Meta for advertising purposes for 5 years, but the fine of Rs 213 crore was retained. NCLAT later clarified that its order in the WhatsApp case related to privacy and consent safeguards also applies to user data collection and sharing.
