What argument did the government give?

Solicitor General of India Tushar Mehta, before a bench of Justices Arvind Kumar and PB Varale, replied to the Supreme Court’s earlier query asking the authorities to consider Wangchuk’s release on medical grounds in view of his deteriorating health condition. Tushar Mehta said- “As per the jail manual, Sonam Wangchuk has been examined regularly about 24 times. She is healthy and fit. She was suffering from digestive problems and infection. If we start making such exceptions (for her release), it will not yield any positive result. The grounds on which the detention order was passed are still applicable. Her release will not be possible due to health reasons. It may not even be desirable. “It has come before us, so we have given it full consideration.”
