New Delhi: Chief Justice of India (CJI) Surya Kant has expressed strong displeasure over the “mushroom growth” of public interest litigations (PIL) in the country’s courts. During the hearing of a case, the CJI remarked that the only agenda of some “prominent faces” was to read the newspaper in the morning and file petitions on it by evening.
“Court’s stance based on news”
According to Live Law report, during the hearing the CJI raised questions about the quality of the petitions and the motives behind them. CJI said that now such famous people are coming forward who approach the court only on the basis of news without any ground research. The top court observed that such petitions lead to wastage of precious court time, which should actually be spent on serving needy people and serious legal issues. Concern was also raised that many times the purpose of these petitions is to stop development projects rather than to serve public interest.
The court has commented earlier also
Earlier, in a decision of 2022, the Supreme Court had commented on the rapidly increasing number of public interest litigation (litigation done to gain fame). The Supreme Court had then said, “However, there is no genuine public interest involved in many such petitions. These petitions are either ‘Publicity Interest Litigation’ or ‘Personal Interest Litigation’ (litigation conducted for personal gain). We strongly condemn this method of filing such frivolous petitions. It is nothing but an abuse of the legal process. Such petitions waste the precious time of the court, which could be utilized. Real and serious issues could have been considered. Now the time has come that such so-called PILs should be dismissed at the initial stage itself, so that the ongoing development work in the larger public interest does not come to a halt.
