The CJI got angry during the hearing on a petition related to liquor in the Supreme Court on Monday (9 March). He warned the lawyer who filed the petition and said that strict action would be taken if such a petition was filed again. He made it clear that this is another example in which a petition will be filed without applying any mind. CJI called this petition baseless and said that the appeals are not clear. In such a situation the petition is rejected. This is an example of bad drafting.

According to Bar and Bench, the court said that the petitioner can contact the concerned authorities as per law. In this petition, a demand was made to make it mandatory to suggest fixed quantity of liquor. Along with this, it was also asked to make rules regarding Tamasic food.

What was the demand made in the petition?

The Supreme Court refused to hear several PILs filed by a lawyer himself as the petitioner. CJI Surya Kant said angrily, “Do you draft all these petitions at midnight?” In the petition, an appeal was made to make fixed prescription of liquor mandatory and regulation on consumption of Tamasik. Issues of property registration etc. were also mentioned in the petition.

What did the CJI-led bench say?

The CJI-led bench said in its order that this petition is another example of lack of brain. The demands are not clear, baseless and have been rejected. This is an example of bad drafting. Had the petitioner not been a lawyer, we would have dismissed the petition with huge expenses. In this case, the court did not impose any fine, but said that if this happens again, a fine will be imposed on the petitioner. The CJI said that this petition is an example of casual drafting and burdening the Supreme Court. Next time you file such a petition, a higher penalty will be imposed. He said angrily that you people have run many such shops.
