Lok Sabha today passed the ‘Transgender Persons (Protection of Rights) Amendment Bill, 2026’. Some arrangements have been made in this bill to ensure the identity of transgenders, which are different from the Transgender Persons (Protection of Rights) Act of 2019. There was a provision in the 2019 Act that any person could declare himself transgender on his own wish and after that he gets a certificate from the DM. But now this system has ended and it has been made mandatory to undergo medical test. DM will be able to give transgender certificate to someone only after medical test.
Why are transgenders protesting?
Apart from this, there is a provision for punishment for forcibly making someone transgender. This bill also states that who can be transgender, it will not include their own free will, due to which many people can be removed from the category of transgender. This is why transgenders are opposing this amendment bill.
What decision did the Supreme Court give?
The Supreme Court had ruled in the case of NALSA vs. Union of India 2014 that self-identification is a fundamental right. Any person can decide whether he is a man, a woman or a transgender. There is no need for any medical examination for this. But here let us tell you that in the bill that the government has now brought, medical examination is necessary, which is against the decision of the Supreme Court.
MPs mentioned characters from Ramayana and Mahabharata
While participating in the discussion on this bill, the MPs also mentioned a story from Ramayana as well as the character of Arjuna as Brihannala in Mahabharata and the story of Lord Vishnu and Mohini. Telugu Desam Party MP Dr B Shabari said that she is closely associated with the people of the transgender community in her parliamentary constituency and their blessings are sought on auspicious occasions. Referring to a story from Ramayana, Shabari said that when Lord Ram was going for exile, he had asked the men and women of Ayodhya to return and when he returned from exile, he found some people waiting for him even after 14 years. According to the MP, when Ram asked them the reason for waiting for so many years, they said that God had ordered the men and women to return and he did not belong to either of these communities, hence they waited for so many years.
Congress MP mentioned Mohini form of Lord Vishnu
The MP said that since then Lord Ram had given the boon to the Kinnar community to bless everyone. He said, “We consider the people of transgender community as ‘Ardhanarishwar and Brihannala’.” Congress’s Gowal Padvi, while participating in the discussion on the bill, also mentioned the mythological story of Samudra Manthan and keeping the Mohini form of Lord Vishnu. He also mentioned Arjuna’s stay in exile in the form of Brihannala in the Mahabharata. Opposing the bill, Padvi said, “We are not against reforms, but we want strong laws.” For this, talks should be held with the transgender community.
