‘Cruelty to children affects the conscience of society’- Delhi High Court

The Delhi High Court refused to cancel the FIR in the case of cruelty towards a minor. The court said that such crimes against children affect the conscience of society on a large scale. These cannot be considered only a private dispute. In June 2023, the child’s mother alleged that his neighbor Amit and his wife Suresta assaulted his child and gave him electric shocks.

Court expressed concern

Justice Swarna Kant Sharma said in an order on July 3 that the child’s mother and accused persons have resolved the matter among themselves, but such acts have not only affected the victim, but also created widespread concerns of public interest, security and protection of children.

The case of 2023 is the case

The accused had moved the court to cancel the FIR lodged in 2023 at Govindpuri police station in the capital Delhi in 2023. The petition underlined a cordial solution of dispute by both sides.

The victim’s child was only 7 years old at the time of the incident

The girl’s mother told the court that she had signed a compromise of her will and without any pressure, force or intimidation. However, the prosecution protested the petition and argued that the allegations were serious and the victim was only seven years old child at the time of the incident.

Such crimes cannot be considered a private dispute

The court said, ‘Such acts not only affect the victim, but also create widespread concerns related to public interest, security and safety of children. Therefore, such crimes cannot be considered only a private dispute, which can only be abolished on the basis of agreement between the parties.

The cancellation of FIR will set a dangerous example

The bench said that the cancellation of the FIR at this level would set a dangerous example and the criminal justice administration will be damaged. The judge referred to the child’s ‘specific’ allegations and ‘consistent’ statements, in which the order of events was clearly stated. (With language input)
