While hearing the petition in the Delhi riots case, the Supreme Court has given a big decision on Monday. The Supreme Court has dealt a blow to jailed Sharjeel Imam and Umar Khalid and rejected their bail plea. However, the Supreme Court has granted bail to 5 other accused in the Delhi riots case. The court has also given the reason for this.

These accused got bail

Actually, the Supreme Court has rejected the bail petitions of Omar Khalid and Sharjeel Imam in the Delhi riots case. Along with this, bail has been granted to activists Gulfisha Fatima, Meeran Haider, Shifa ur Rehman, Mohammad Salim Khan and Shadab Ahmed in the riots case. The Supreme Court has said in its decision that the situation of Umar Khalid and Sharjeel Imam is different compared to other accused in the Delhi riots case.

What did the Supreme Court say regarding bail?

While hearing this case, the Supreme Court talked about the aspects of bail. The court said- “Separate and strict criteria of bail apply under the law in cases of offenses related to the security of the country. The court said that if the allegations of the police appear prima facie true from the material available, then custody (imprisonment) will be given preference but if it is not so, then bail should be granted.”

Comment on Omar Khalid and Sharjeel Imam

The Supreme Court also clarified that “Umar Khalid and Sharjeel Imam do not meet the test of Section 43D(5) of the UAPA. As a result, the bail pleas of Omar Khalid and Sharjeel Imam were rejected. The Supreme Court clarified in the order that the criteria for bail in crimes related to national security are different and strict. If the allegations appear prima facie true, the detention will continue. If prima facie the allegations do not appear true, the Supreme Court clarified in the order that Bail will be granted.”

The Supreme Court said that “The Court has deliberately refrained from adopting a collective or integrated approach. The Court is satisfied that the prosecution material prima facie proves the charges against the Appellants Umar Khalid and Sharjeel Imam. The statutory limit of limitation applies in respect of these Appellants. It is not appropriate to release them on bail at this stage of the proceedings.”
