The Supreme Court on Monday made a big comment while hearing the bail plea of the accused in a rape case by making a false promise of marriage. The court has said that before marriage the boy and the girl are complete strangers. Therefore, they should be cautious in having physical relations before marriage. The court also said that one should not trust anyone before marriage.
What did the court say?
Actually, the bench of Supreme Court Justice BV Nagarathna and Justice Ujjwal Bhuyan was hearing the bail plea of an accused in a case of rape on the pretext of marriage. During the hearing, the court asked the complainant woman why she had gone to Dubai to have physical relations. The court said – “This happens with mutual consent. We may be old-fashioned, but before marriage, the young man and the woman are complete strangers to each other. Before divorce, they should be cautious in having physical relations.” While hearing the case, Justice Nagarathna said, “Whatever ups and downs there may be in the relationship between a boy and a girl, we are not able to understand how they can have physical relations before marriage. It may be that we are old-fashioned, but you should be very cautious.”
During the hearing in the Supreme Court, Justice Nagarathna said that this case appears to be a consensual relationship. He said it would be sent for arbitration. These are not cases in which consensual sex should be prosecuted and punished. Justice Nagarathna told the accused’s lawyer to close the case by giving compensation to the woman. The court has also asked the woman’s lawyer to explore the possibility of a compromise and has fixed the next hearing in the case on Wednesday.

The complainant woman has claimed that she had gone to Dubai at the behest of the accused youth. There the young man allegedly made a false promise of marriage and had physical relations with the woman. The woman alleges that the young man made her intimate videos without any permission and also threatened that he would make it viral. The woman has alleged that later she came to know that the young man had married another woman in Punjab in the month of January 2024. In the case, the Delhi High Court and the lower court had rejected the bail plea of the youth. Delhi High Court, while rejecting the young man’s petition, had said that prima facie there was indication that the promise of marriage was false from the beginning. Especially because the young man was already married and had remarried on January 19, 2024. After this the young man approached the Supreme Court for bail. (input language)
