Investigate all hawkers and their helpers, take action against infiltrators – Bombay High Court

Bombay High Court has directed BMC and Mumbai Police to investigate all the hawkers and their helpers in Mumbai. The court has said that if illegal infiltrators are found, action should be taken against them and action should also be taken against the officers responsible. Bombay High Court has given strict orders on the issue of illegal hawkers and infiltration in Mumbai. The court has said that

All the hawkers, stall owners and their helpers of Mumbai should be thoroughly investigated, their identity and documents should be verified. If any illegal infiltrator is found, action should be taken against him as per law.

Bombay High Court has given strict instructions to BMC and Police regarding unauthorized hawking going on in Mumbai and illegal stalls set up on roads and footpaths. The court has clearly said that all the temporary and permanent stalls installed in the city should be inspected, whether they are creating obstruction to pedestrians or traffic or not. The court has also said that the identity of not only the hawkers but also the helpers and assistants working with them should be checked.

Demand for strict action against illegal immigrants

If during investigation any person is found to be living illegally or is an illegal migrant, then immediate legal action should be taken against him. The court has even said that if necessary
Repatriation action should also be taken as per the legal process. The most important thing is that the High Court has warned BMC and police officers that if this order is not implemented, then personal responsibility of the officers concerned will be fixed.

Hearing on petition related to unauthorized hawkers

The court gave this order during the hearing of the case Maharashtra Ekta Hawkers Union vs State of Maharashtra. This hearing was being held on several petitions filed regarding unauthorized hawkers in Mumbai. When one party sought a stay to put a stay on this order and approach the Supreme Court, the High Court rejected this demand. The court said that in the implementation of the Street Vendors Act
There has already been a delay of 7 years due to continuous litigation.

Officers will be held accountable

After this order of Bombay High Court, the expectation of major administrative action has increased on the issue of illegal hawkers, encroachment and illegal infiltration in Mumbai. The biggest thing is that this time not only the department but the officers themselves will be accountable.
