‘Nobody will give jobs to women like this’, SC rejects petition on menstrual leave

Menstrual Leave Plea: The Supreme Court has rejected a PIL demanding a national policy on Menstrual Leave for women and girl students across the country. The Supreme Court said that if it is made mandatory through law, it may have an adverse effect. Because of this, women may face difficulties in getting jobs in the future.

Gender Stereotypes may increase

In the hearing held in the Supreme Court on Friday, the bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi made this important comment. The Supreme Court said that such a provision is likely to inadvertently reinforce gender stereotypes about women.

The concerned competent authority can consider the policy

However, the Supreme Court also said that the competent authority concerned can consider the representation given on this issue. Can study the possibility of making a policy on Menstrual Leave after consulting all stakeholders. With this instruction the petition regarding menstrual leave has been disposed of.

Petitioner’s lawyer had given the example of Kerala

Know that this petition was filed by Shailendra Mani Tripathi. Senior advocate M.R. appeared on behalf of the petitioner. Shamshad said during the hearing that some states and institutions of the country have already taken steps in this direction. Giving an example, he said that some relief has been given in this regard in schools in Kerala. Many private companies are also giving menstrual leave to their employees.

Voluntary leave a welcome step

On this the CJI said, ‘Voluntary leave is welcome, but it is not right to make it mandatory under the law. If this is made mandatory as a law, then employers will shy away from giving jobs to women. This can have a negative impact on the careers of women.
