New Delhi: The opposition is preparing to bring an impeachment motion against the country’s Chief Election Commissioner (CEC) Gyanesh Kumar. Sources say that the opposition may bring an impeachment motion against the CEC within a day or two. Sources claim that 120 MPs in the Lok Sabha and 60 in the Rajya Sabha from the India Block have signed the impeachment motion notice against Chief Election Commissioner Gyanesh Kumar. This proposal will bring opposition in both the houses. According to sources, opposition MPs can submit this proposal on March 12 or 13.
According to sources, in the impeachment motion, proven misconduct, biased, discriminatory behavior and SIR exercise and stopping people from voting on a large scale are some of the main grounds mentioned in the draft of the motion to be brought by the opposition for impeachment against Chief Election Commissioner (CEC) Gyanesh Kumar.
What are the charges in impeachment
- There is an allegation of depriving the voters of their voting rights.
- Allegations of misbehavior with TMC leaders when their delegation went to meet the Election Commission.
- Allegations of misuse of constitutional institutions.
Congress MP Imran Masood said while talking to India TV that we are fighting to save the Constitution. Will do whatever is needed for that. Let us tell you that CEC can be removed under Article 324 (5) of the Constitution, in which the same provisions as for removal of judges are also there for removal of CEC. If the opposition brings this proposal, it will be for the first time in the history of the country.
Earlier in 1993, standing at the threshold of Parliament, Kapil Sibal, at that time just a lawyer, had advocated in support of Justice V Ramaswamy in his first impeachment. They argued for 6 hours. After this, Congress leaders were so impressed by his performance as a lawyer that they made him join the party and gave him a ticket. This motion was defeated.
