Shock to Mamta, SC gives verdict on SIR; Voter list deadline extended in Bengal

New Delhi: Amidst the ongoing tussle over Special Intensive Revision (SIR) in many states of the country, West Bengal Chief Minister Mamata Banerjee has received double disappointment from the Supreme Court. On one hand, his attempt to advocate as a lawyer himself failed, on the other hand, the Supreme Court has strongly reprimanded the Bengal government over the violence and threats against Election Commission (ECI) officials.

“No interruption to the process”

Chief Justice D.Y. The bench headed by Chandrachud and Justice Surya Kant made it clear that no restriction can be imposed on the SIR process. The court clearly said that no obstruction will be allowed in this process. The top court warned the states that no obstruction of any kind will be allowed in the investigation process. The Supreme Court said that there is no need for the states to intervene in any way in this matter.

Attack on Election Commission officers

At the same time, during the hearing, the Solicitor General (SG) and other lawyers told the court that Election Commission officials are being intimidated in Bengal and violence is being done against them. Taking a serious stand on this, the court has ordered the DGP of Bengal to file his personal affidavit. He will have to explain the allegations made by the Election Commission and the security lapses.

The petitioners (Naidu and Giri) told the court that violence is taking place on the streets and the police is not even registering an FIR. Even the Chief Electoral Officer (CEO) was not spared. Chief Justice D.Y. The bench of Justice Chandrachud and Justice Surya Kant clearly said, “No obstruction will be allowed in the process.”

Voter list deadline extended

At the same time, in view of the induction of new batch of administrative officers and the huge number of documents, the court has given relief in the time limit. The February 14 deadline for scrutiny of documents and publication of the final voter list has been extended by a week. Now ERO (Electoral Registration Officer) will have time till 21st February to take a decision.

The court has directed the state government to report for duty by 5 pm tomorrow, all 8505 Group-B officers included in the list. The Election Commission will have the right to replace the existing ERO/AERO or to continue their services if found eligible.
