‘So many applications do not come even in human cases’, SC on the case of stray dogs

The Supreme Court on Tuesday took cognizance of the number of interim applications being filed before it in the case of stray dogs. The court said that generally such a large number of applications are not received even in cases related to humans. A bench of Justices Vikram Nath and Sandeep Mehta made these observations when two lawyers raised the issue of stray dogs before them.

Judge Mehta made this comment

A lawyer said he has filed an interim petition in the case. Commenting on this, Judge Mehta said, ‘Normally such a large number of petitions are received even in cases involving human beings.’

Now hearing will be held on Wednesday

The bench said that the stray dogs case will be heard in the Supreme Court on Wednesday. When another lawyer mentioned the transfer petition in the case, the court said that several petitions would be heard on Wednesday and the bench would hear all the lawyers. A three-judge special bench comprising Justice Vikram Nath, Justice Sandeep Mehta and Justice NV Anjari will hear the case on Wednesday.

The court had given this instruction in November last year

Noting the ‘alarming increase’ in incidents of dog bites in institutional areas like educational institutions, hospitals and railway stations, the Supreme Court on November 7 last year had directed to immediately shift stray dogs to designated shelters after proper sterilization and vaccination.

Instructions were given to remove dogs from the highway

The court also said that stray dogs so caught will not be released back to the place from where they were caught. The Court directed the authorities to remove all cattle and other stray animals from state highways, national highways and expressways.

The Court said that recurring incidents of dog bites in institutional areas, including sports complexes, not only reflect administrative apathy but also highlight the ‘systemic failure’ in securing these complexes from preventable threats.

Court is hearing the suo motu case

The court had taken suo motu cognizance and issued several instructions in the case of stray dogs. The court is hearing a suo motu case initiated on July 28 last year in connection with media reports of spread of rabies, especially among children, due to the bite of stray dogs in the national capital.
