Submission of false certificate of assets to the Election Commission – Dinesh Kallahalli’s appeal to the Governor for permission to file a complaint against Shivraj Thangadagi! – Btv Kannada

Bangalore: Social activist Dinesh Kallahalli has appealed to the Governor to allow him to file a private complaint against Karnataka Backward Classes Development Minister Shivraj S Thangadagi.

Shivraj S. Thandagagi deliberately did not disclose certain properties in his nomination affidavit submitted to the Election Commission, gave false information to the Election Commission, concealed the real property details and submitted a false affidavit to the Election Officer. So a private complaint should be filed against Thandagai in the Special Court of People’s Representatives and necessary legal action should be taken. Dinesh Kallahalli has written to the Governor seeking prior approval under Sections 17A and 19(1) of the Prevention of Corruption Act, 1988, and Section 218 of the Indian Civil Protection Code, 2023.

What’s in the letter?

During the 2023 Karnataka assembly elections, Shivraj S. was a candidate for the Kanakagiri assembly constituency. It is clear that Thandagagi has deliberately misled the Election Commission by giving false and false information by not disclosing the assets registered in his wife’s name in his nomination affidavit submitted to the Election Commission. When I downloaded and checked the relevant affidavit through the official website of the Election Commission, many flaws and mistakes were found there. It appears that the candidate has deliberately concealed the true details of his and his family’s assets.

They have spoiled the sanctity of the election process, given false information to the voters of Kanakagiri polling station and made false declarations to instill confidence in the voters. An act contrary to public interest has been proved. By doing this they misled the voters of Kanakagiri constituency. On the basis of false information, he won the election as an MLA and currently holds the post of Minister in the Government of Karnataka. This act violates the sanctity of the election process and is a serious crime.

This act fits the offense under Indian Penal Code Section 318(2) of creating and submitting to a public officer a false document or affidavit. By submitting this false affidavit, he is also guilty of the offense of ‘false declaration or false affidavit’ under Section 125A of the Representation of the People Act, 1951. Thus, in the wake of the above acts, Shivraj S. Social activist Dinesh Kallahalli appealed to the Governor that legal investigation should be initiated against Thandagai and criminal proceedings should be initiated against him.
