The Supreme Court again reprimanded the Mamata government of West Bengal in the I-PAC, ED raid case and asked, what will happen to the fundamental rights of ED officials? When Mamata Banerjee raised objection to the ED petition, the bench of Justices PK Mishra and NV Anjari said, do ED officers not cease to be citizens of India merely because they are ED officers? SC questioned the objections raised on maintainability of ED’s petition and asked – Can ED approach the state police if the Chief Minister obstructs the ED raid?
If your government is in power at the centre…
The Supreme Court once again reprimanded the Mamata Banerjee government in the I-PAC case and asked, what will happen if your government is in power at the Center and another political party does the same at the state level? The Supreme Court asked this question to the Mamata Banerjee government when it was hearing the case of alleged interference by the Bengal Chief Minister. The case related to interference in the search operation against political consultancy firm I-PAC.
The Enforcement Directorate (ED) has accused Bengal Chief Minister Mamata Banerjee and state officials of interfering in the investigation and searches at the offices of Indian Political Action Committee (I-PAC), a political consultancy firm working with Trinamool. The raids were carried out in early January as part of a money laundering investigation.
CJI also commented on SIR
CJI Surya Kant’s comment during the hearing in the case related to West Bengal SIR, said – Except West Bengal, the implementation of SIR has been done smoothly in all other states. There is not much litigation regarding SIR in other states. State lawyers say there is a ‘logical inconsistency’ as the law has been implemented only in West Bengal.
