Supreme Court will not hear the petition against Himanta Vishwa Sharma

The Supreme Court has refused to hear the petition filed against Assam Chief Minister Himanta Vishwa Sharma. The bench headed by CJI Surya Kant said that the Supreme Court is not a playground to settle any kind of case. Along with this, the petitioner was advised to appeal in the High Court. In this petition it was said that criminal action should be taken against Assam CM Himanta Vishwa Sharma. Because he had commented against the Muslim community.

The Supreme Court directed the Gauhati High Court to hear this matter immediately. The top court said that the petitioner should have faith in the system. Advocate Abhishek Manu Singhvi argued that this is a matter of statements made in many states. Statements were made in Assam, Jharkhand and one other state. The CJI said that you should come through the High Court. We will listen. Supreme Court is not a playground to settle any case. When the High Court has the power under the Constitution to issue appropriate orders on your petition. But he is an oath holder and is openly violating it every day, Singhvi said. He has given these statements in the states of Assam, Chhattisgarh and Jharkhand. The CJI said that we can only request the High Court that this is an important matter and that it should hear it as per its merits.

What is the matter?

Several petitions were filed against Himanta Vishwa Sharma in the Supreme Court. In these, citing Himanta’s ‘Mian Muslim’ statement and his viral video on social media, there was a demand for registration of FIR and SIT investigation. This petition was filed by Communist Party of India, CPI leader Annie Raja. Recently, a video of Himanta Vishwa Sharma also went viral. In this video, the Chief Minister of Assam is shown aiming a gun at some people wearing Muslim caps. It was written with this video that no one should show mercy. After this video went viral, there was a huge uproar and later the video had to be deleted from the party’s handle. Himanta is on the backfoot regarding this video. Now there will be a hearing against him in the High Court.
